1. Scope and Contracting Parties<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t
    \n\t\t\t\t\t\t\t
  • \u2022General:<\/b> These Terms and Conditions apply to all contracts, bookings, and services provided between the guest and the dive center Liquid Blue Bali (hereinafter referred to as the \"Dive Center\"). The Dive Center is legally operated and represented by the registered company PT Bali Dive and Speed (Amed St, Bunutan, Karangasem Regency, Bali 80852, Indonesia). The contracting party for the guest is exclusively PT Bali Dive and Speed.<\/span><\/li>\n\t\t\t\t\t\t\t\t
  • \u2022Bookings:<\/b> A booking only becomes legally binding once it has been confirmed by us in writing and\/or the required deposit has been received by us in full.<\/span><\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t

    2. Payment Terms and Cancellation Policy<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t
      \n\t\t\t\t\t\t\t
    • \u2022 Deposits:<\/b> For courses, a prepayment of 50% of the respective course price is required to unlock the PADI e-Learning materials.<\/span><\/li>\n\t\t\t\t\t\t\t\t
    • \u2022 On-site Payment:<\/b> We accept cash payments in Euro and IDR, transfers via Wise, as well as credit card payments with Visa or Mastercard. For card payments, a bank surcharge of 3% will be applied.<\/span><\/li>\n\t\t\t\t\t\t\t\t
    • \u2022 Cancellations by the Dive Center:<\/b> The Dive Center reserves the right to cancel dives at any time for safety reasons (e.g., weather, sea conditions, illness). In this case, the affected dives will be fully refunded or rescheduled free of charge.<\/span><\/li>\n\t\t\t\t\t\t\t\t
    • \u2022 Cancellations by the Guest:<\/b> For cancellations made by 6:00 PM on the day before the scheduled dive, a fee of 30% of the price will be charged. For cancellations made after 6:00 PM on the day before or on the day of the dive itself, a fee of 50% will apply.<\/span><\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t

      3. Dive Packages and Services<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t
        \n\t\t\t\t\t\t\t
      • \u2022 Inclusions:<\/b> The price includes hotel pickup within the Amed area, full rental equipment (excluding dive computers), tanks, weights, towels, snacks, and lunch, as well as guidance by a dive guide or instructor.<\/span><\/li>\n\t\t\t\t\t\t\t\t
      • \u2022 Nitrox:<\/b> Certified Nitrox divers receive Nitrox at no extra cost (\u201cNitrox for free\u201d). However, in the event of technical compressor failure, there is no entitlement to a price reduction or refund, as this is a complimentary additional service.<\/span><\/li>\n\t\t\t\t\t\t\t\t
      • \u2022 Package Downgrading:<\/b> If a booked dive package (e.g., 10 dives) is not used in full, it will be downgraded to the next smaller package or to the price of individual dives in the final invoice.<\/span><\/li>\n\t\t\t\t\t\t\t\t
      • \u2022 Transferability:<\/b> Dives from a booked package can be transferred to another person, provided that they hold a valid diving certification and meet the health requirements for diving.<\/span><\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t
        \n\t\t\t\t\t

        4. Participation Requirements (Health & Safety)<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
        \n\t\t\t\t\t\t\t
          \n\t\t\t\t\t\t\t
        • \u2022 Certification:<\/b> The guest must present a valid certification card and a logbook before starting any diving activities.<\/span><\/li>\n\t\t\t\t\t\t\t\t
        • \u2022 Medical Questionnaire:<\/b> Before the first dive, the mandatory PADI Medical Statement must be completed truthfully. In the case of pre-existing conditions, a medical certificate of fitness for diving is mandatory.<\/span><\/li>\n\t\t\t\t\t\t\t\t
        • \u2022 Refresher Policy:<\/b> For the guest's safety, the Dive Center reserves the right to require a Scuba Refresher if the guest's last dive was a long time ago or if their underwater skills are insufficient for the planned dive site.<\/span><\/li>\n\t\t\t\t\t\t\t\t
        • \u2022 Alcohol and Drugs:<\/b> A strict \"no diving\" policy applies under the influence of alcohol or drugs. In the event of a violation, the guest will be excluded from diving activities without any entitlement to a refund.<\/span><\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t
          \n\t\t\t\t\t

          5. Liability for Rental Equipment<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
          \n\t\t\t\t\t\t\t
            \n\t\t\t\t\t\t\t
          • \u2022 Duty of Care:<\/b> The guest is obliged to treat the provided rental equipment with care. This applies from the moment it is issued at the dive center until it is returned.<\/span><\/li>\n\t\t\t\t\t\t\t\t
          • \u2022 Damage and Loss:<\/b> In the event of negligent or intentional damage (e.g., stepped-on regulators, torn-off mouthpieces) or the loss of equipment items, the guest is fully liable for the costs.<\/span><\/li>\n\t\t\t\t\t\t\t\t
          • \u2022 Basis of Calculation:<\/b> The replacement value of the respective item in Bali will be invoiced. This also includes any applicable shipping costs and Indonesian import taxes. Normal wear and tear (e.g., O-rings, bungees) is excluded.<\/span><\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t\t

            6. Authority to Issue Instructions and Changes to the Itinerary<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t\t\t\t
              \n\t\t\t\t\t\t\t
            • \u2022 Decision-making Authority:<\/b> The instructors and dive guides of the Dive Center have the final say at all times in all safety-related matters (both above and below water). For your own safety, the instructions of the staff must be strictly followed.<\/span><\/li>\n\t\t\t\t\t\t\t\t
            • \u2022 Change of Itinerary:<\/b> If external conditions (e.g., weather, current, poor visibility) at a planned dive site do not allow for safe diving, an alternative dive site will be visited at the staff's discretion. Such a safety-related change of itinerary does not entitle the guest to a price reduction or refund.<\/span><\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t
              \n\t\t\t\t\t

              7. Liability Waiver (Personal Property & Injuries)<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

                \n\t\t\t\t\t\t\t
              • \u2022 Luggage & Valuables:<\/b> The Dive Center assumes no liability for the loss, theft, or damage of private items (e.g., smartphones, cameras, personal diving equipment) on the premises of the dive center, on the boats, or in the transfer vehicle.<\/span><\/li>\n\t\t\t\t\t\t\t\t
              • \u2022 Personal Responsibility:<\/b> Diving is a high-risk sport. The liability of the Dive Center and its employees is limited to intent and gross negligence. Every guest is required to sign the standard PADI Liability Release before starting any diving activities.<\/span><\/li>\n\t\t\t\t\t\t\t\t
              • \u2022 Insurance:<\/b> The Dive Center maintains standard business liability insurance for the facility and staff. Personal diving accidents involving the guest (e.g., necessary hyperbaric chamber treatments) are not covered. We strongly recommend obtaining specialized diving accident insurance (e.g., DAN or AquaMed), unless the guest's regular international health insurance explicitly covers diving accidents.<\/span><\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t
                \n\t\t\t\t\t

                8. Jurisdiction and Final Provisions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
                \n\t\t\t\t\t\t\t
                  \n\t\t\t\t\t\t\t
                • \u2022 Applicable Law:<\/b> The entire contractual relationship between the guest and PT Bali Dive and Speed shall be governed exclusively by the laws of the Republic of Indonesia.<\/span><\/li>\n\t\t\t\t\t\t\t\t
                • \u2022 Jurisdiction:<\/b> To the extent permitted by law, Denpasar (Bali, Indonesia) is agreed upon as the exclusive place of jurisdiction for all disputes arising out of or in connection with this contract.<\/span><\/li>\n\t\t\t\t\t\t\t\t
                • \u2022 Severability Clause:<\/b> Should individual provisions of these General Terms and Conditions be or become ineffective or unenforceable after the conclusion of the contract, the effectiveness of the remaining provisions shall remain unaffected.<\/span><\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"
